User Agreement

1.1 These Terms of Service (hereinafter referred to as the "Terms") constitute a valid contract between you (hereinafter referred to as the "User" or "you") and Huajun Zhisuan (hereinafter referred to as "XABLE" or "we") regarding the use of XABLE platform services. 1.2 The XABLE platform includes the domain xable.com.cn and its sub-pages and clients. 1.3 If you use or purchase a specific product or service on the XABLE platform (including but not limited to model API calls, GPU compute rental, AI app marketplace, AI Academy training, etc.), you must also acknowledge and comply with the specific terms of service applicable to that service.

2.1 Eligibility: You must be a natural person, legal entity, or other organization with full civil capacity and civil legal capacity. If you are a minor, you and your guardian shall bear all consequences arising from improper registration. 2.2 Account registration: You must provide true, accurate, and complete registration information (including email, phone number, etc.) and be responsible for its authenticity. Your chosen account name must not violate laws, regulations, or public morality. 2.3 Account security: You shall properly safeguard your account password and API Key. Losses caused by account information leakage shall be borne by you. One account may correspond to only one legal entity and may not be transferred, lent, or resold in any way. 2.4 If you discover your account has been compromised, please contact us immediately. All actions taken before that point are deemed to be your own. 2.5 The same user may not maliciously register multiple accounts; violators may have their related accounts frozen by us.

3.1 When using XABLE services, you shall comply with all applicable laws and regulations and must not use the platform for any illegal activity. 3.2 The following acts using XABLE are prohibited: (1) Disseminating illegal information or content that infringes on the lawful rights of others; (2) Attacking, penetrating, reverse engineering, or interfering with normal services of the platform system; (3) Using the API for high-frequency malicious calls, traffic inflation, or abuse of platform resourcess; (4) Using the platform services for illegal scraping, generating illegal content, or other violating purposes; (5) Engaging in illegal businesses such as issuing, trading, or mining virtual currencies; (6) Unauthorized use of open-source software under the AGPL license. 3.3 If you violate the above rules, XABLE reserves the right to delete information, suspend, or terminate services, and may freeze or deactivate your account. 3.4 In principle, the service is for your own use only. If you use it for a third party, you must inform them and require compliance with these Terms; you bear joint liability for all third-party actions.

4.1 XABLE services are billed by usage (model API by tokens, GPU instances by duration), with specific prices subject to platform publication. 4.2 Fees are deducted from your account balance in real time. GPU compute uses a pre-freeze mechanism: a 24-hour fee is frozen when an instance is created, deducted per minute based on actual usage, and the remaining frozen amount is refunded when the instance is stopped. 4.3 Recharged amounts are non-refundable once credited. For special circumstances, please contact customer service to negotiate. 4.4 Upon arrears, we will issue a demand and reserve the right to suspend services. If arrears exceed the grace period, we may delete your business data, which is unrecoverable. 4.5 XABLE reserves the right to adjust prices, with notice given via announcement or email before any change takes effect.

5.1 All content on the XABLE platform, including but not limited to software, technology, interface design, trademarks, and logos, is owned by Huajun Zhisuan. 5.2 The intellectual property rights of content you generate through the XABLE platform belong to you. You must ensure your input does not infringe third-party intellectual property rights. 5.3 You are responsible for the source and legality of your business data and shall back it up yourself. 5.4 Any unauthorized copying, modification, dissemination, or commercial use of XABLE platform content is prohibited. 5.5 You may not reverse engineer, decompile, or disassemble the software used by XABLE services.

6.1 XABLE takes user privacy protection seriously. Please refer to the Privacy Policy for details on how we collect and use your personal information. 6.2 By using this platform, you agree that we process your personal information in accordance with the Privacy Policy. 6.3 We adopt security measures such as encryption and access control to protect your data. However, we do not guarantee absolute security; you should take reasonable security measures to protect your account and data.

7.1 XABLE provides services "as is," striving to ensure continuity and security, but cannot foresee and prevent all technical and legal risks at all times. 7.2 XABLE is not liable for service interruptions caused by force majeure (including but not limited to natural disasters, war, policy changes, cyberattacks, power failures, etc.). 7.3 XABLE makes no warranty regarding the accuracy or legality of the output of third-party model providers. 7.4 To the maximum extent permitted by law, XABLE is not liable for indirect losses arising from the use of the services. XABLE's aggregate liability shall not exceed the total fees you paid to XABLE in the preceding 12 months. 7.5 You shall bear any third-party claims arising from your use of the services, violation of these Terms, or any action taken under your account.

8.1 You may apply to delete your account at any time. After deletion, you will be unable to recover personal information, transaction records, business data, etc. under that account. 8.2 If you violate these Terms, XABLE reserves the right to suspend or terminate your account access and to pursue legal liability. 8.3 If you do not log in for 12 consecutive months and there are no unexpired services under your account, XABLE may delete your account. 8.4 Account deletion does not affect XABLE's confirmation of your true identity as required by regulatory authorities or in other lawful scenarios. 8.5 After account deletion, the recharge balance will not be refunded.

XABLE may modify these Terms of Service as needed. The modified terms take effect after being published on the platform or notified by other means. If you do not agree to the modified terms, you should stop using the service. Continued use of the XABLE platform constitutes acceptance of the modified terms. We recommend reviewing this page periodically.

These Terms are governed by the laws of the People's Republic of China. Disputes arising from or related to these Terms shall be resolved through friendly negotiation; if negotiation fails, either party may submit the dispute to a court with competent jurisdiction.
